Arrest Report 9.29.11

The following information is provided courtesy of Avery County Sheriff’s Office. All suspects are considered innocent until proven guilty in a court of law.

Patrick James Benfield, 29, arrested Sept. 19 for driving while impaired, no operator’s license.
Michael Scott Eggers, 44, arrested Sept. 19 for defrauding innkeeper, assault on a female.
Sampson Gwyn, 77, arrested Sept. 19 for second-degree trespass.
Craig Allen Baird, 46, arrested Sept. 20 for driving while license revoked.
Sean Edward Gray, 24, arrested Sept. 20 for driving while license revoked, resisting public officer, providing fictitious/false information to an officer.
Buddy Joe Hamby, 50, arrested Sept. 20 for protective order violation, assault on a female, possession with intent to manufacture/sell/deliver marijuana, possession of marijuana from .5 to 1.5 ounces, possession of drug paraphernalia.
Charlie Lee Mathis, 31, arrested Sept. 20 for assault on government official/employee.
Michael Pierce, 37, arrested Sept. 20 for assault on government official/employee. 
Adam Wayne Harmon Jr., 18, arrested Sept. 21 for possession of stolen goods.
James Edward Miller, 17, arrested Sept. 21 for simple possession of schedule IV controlled substance.
Johnny Harrison Ollis, 33, arrested Sept. 22 for failure to appear for child support.
Gage Adam Rodman, 17, arrested Sept. 22 for simple possession of schedule IV controlled substance.
Daniel Taylor, 29, arrested Sept. 22 for possession/distribute methamphetamine precursor. 
Philip Cody Franklin, 22, arrested Sept. 23 for felony possession of marijuana, possession with intent to manufacture/sell/deliver marijuana, felony possession of schedule I controlled substance, simple possession of schedule III controlled substance, possession of drug paraphernalia. 
Teddy Ray Aldridge, 33, arrested Sept. 24 for robbery with dangerous weapon.
Bradley Dewayne Hodges, 35, arrested Sept. 24 for robbery with dangerous weapon.
Anna Marie Hughes, 29, arrested Sept. 24 for robbery with dangerous weapon.
Shannon Elaine Trice, 30, arrested Sept. 24 for robbery with dangerous weapon. 
Sheriff’s Report

On Sept. 19, officers with Avery County Sheriff’s Office arrested Buddy Joe Hamby, 50, of Newland. Officers went to the residence to arrest Hamby on a domestic violence warrant. Once at the residence, officers found marijuana and drug paraphernalia. 

On the evening of Sept. 20, officers with Avery County Sheriff’s Office made a traffic stop on Miller’s Gap Highway. The officers located stolen property inside the vehicle. A follow up investigation by Avery County Sheriff’s Office detectives has identified three individuals involving three church break-ins. These individuals are currently assisting the Avery County and Burke County sheriff’s offices in recovering most of the property stolen. Arrests will be forthcoming. 

“It is of critical importance to us to find and recover the property which was stolen, not just because of the monetary value but also the sentimental value some of these items had to the their owners,” said Sheriff Kevin Frye. Frye would also like to thank Burke County Sheriff’s Office for sending a deputy to work with Avery County from Tuesday through Friday. Tips from the community helped assist officers in the identification of these suspects and recovery of the property. 

On Sept. 21, officers with Avery County Sheriff’s Office assisted North Carolina probation and parole officers in the search of a residence on Miller’s Gap Highway. Daniel Taylor, 29, of Newland was arrested and charged with possession of methamphetamine precursors. 

On Sept. 22, Avery County Sheriff’s Office assisted Avery County Drug Task Force in the search of a residence on Balm Highway in Banner Elk. Officers located marijuana and drug paraphernalia. Phillip Franklin, 22, of Banner Elk has been charged with possession of marijuana and possession of schedule I Narcotics. 

On the morning of Sept. 24, Banner Elk Police Department responded to a call about an alleged armed robbery. The victim was on his way home from a bar in Banner Elk when he was robbed. Responding officers received a description of the suspects and a vehicle driven by the suspects. Officers with Avery County Sheriff’s Office located a vehicle matching the description at a motel in Linville. Four occupants of a room at the motel were later identified by witnesses and the victim of the robbery. The four were arrested and charged with robbery with a dangerous weapon. The four individuals are identified as Shannon Trice Kirkpatrick, 30, of Newland; Anna Hughes, 29, of Newland; Bradley Hodges, 35, of Banner Elk; and Teddy Aldridge, 33, of Morganton.
