Ollis waives extradition, court date to come

Last week, Avery County Sheriff’s Office announced that it is investigating the death of a six-week-old infant, Colton Ollis. The sheriff’s office also announced that it was seeking Jacob Ollis, the infant’s father, under a warrant for second-degree murder. Ollis was arrested on Saturday, Jan. 14, by Carter County Sheriff’s Office for a failure to appear charge. After the arrest, Carter County authorities discovered the outstanding warrant from North Carolina.

Avery County Sheriff’s Office immediately sought extradition to return Ollis to Avery County to stand trial in the death of his son. Last week, Ollis waived extradition, which resulted in his return to custody in Avery County on Monday, Jan. 23, according to Britt Springer, assistant district attorney. Springer also explained that, by waving extradition, Ollis avoided additional court appearances in Tennessee while speeding up his return to North Carolina.

“If he did not waive extradition, Tennessee would have to have a court date for him, he could be appointed an attorney and he could fight extradition,” explained Springer. “You can fight extradition, but most of the time it does not happen. The only thing Tennessee has to see is that it is a valid warrant.”

According to Springer, no court date has been set for Ollis’ case, but one should be established in short order.

“It will be soon. Within two weeks, he will have a court date,” said Springer.
